NYC Subway Choker Indicted
Daniel Perry, the man who choked and killed a homeless man on a NYC subway, was indicted by a grand jury, enabling a future criminal trial. Neely is accused of killing a former Michael Jackson impersonator, who struggled in recent years with homelessness and mental illness, by holding him in a chokehold because he was acting irrationally. The man was shouting at passengers and begging for money when Penny held him down on the floor of the subway car, with help from two other passengers. Penny held Neely in a chokehold for more than 3 minutes before police arrived on the scene. Penny is a former U.S. marine.
